Terms of Service

This is an agreement between you and Pody, including but not limited to Pody.ai (a product of Ecomdy Media Company Limited) and its affiliates operating pody.ai (“Pody” or “we”).

Please read these Terms of Service carefully, together with any other applicable rules, policies, and terms published on the pody.ai website. By using any services provided on Pody (collectively, the “Services”), you agree to be bound by the terms of this Agreement on behalf of yourself, your company, and any other persons who use the Services under your account. You are fully responsible for all use of the Services that occurs under your account, whether such use is carried out by you directly or by any third party authorized by you. If you do not agree to any of these terms, please do not access or use the Website, the Services, or any information available on Pody. Your use of any Services is subject to any additional rules, policies, and terms applicable to such Services.

We reserve the right to update and change these Terms of Service by posting updates on the Website. You are advised to review such updates regularly to stay informed of any changes that may affect you. Pody may impose limits on certain features or Services, or restrict your access to part or all of the Services at any time without prior notice or liability. If you do not accept such changes, you must cease using the Services. Your continued use of the Website or the Services after the changes are posted constitutes your acceptance of those changes.

Your use of the Services is also subject to Pody’s Privacy Policy, which forms an integral part of these Terms.

You must read, agree to, and accept all terms and conditions contained in or expressly referenced in these Terms of Service before accessing the Website and using the Services.

1. Use of Services​

a. Requirements​

  • By agreeing to these Terms of Service, you represent that you are of legal age under the laws of your place of residence, or that you are of legal age and have given consent for your minor dependents to use the Services.

  • You must not use the Services for any unlawful or unauthorized purpose, nor may you violate any laws in your jurisdiction (including but not limited to copyright laws).

  • You must not transmit any malware, viruses, or any code of a destructive nature.

  • The Website does not contain discriminatory content based on age, gender, race, ethnicity, nationality, religion, sexual orientation, or any other protected status.

b. Services and Registration​

Pody uses artificial intelligence systems to generate certain digital content created by users through the Services (such content, “Assets”).

To use the Services, you must register for a Pody account (“Account”) and become a user of the Services. Pody offers multiple membership tiers, including a free tier (“Free Tier”) and paid subscription tiers. Users of the Free Tier have limited usage rights, while users of paid subscription tiers have rights corresponding to the subscription plan selected.

c. Access to Pody​

The Services are provided on an “as is” and “as available” basis. By using the Services, you acknowledge and agree that all risks arising from such use are borne solely by you.

We do not guarantee that Pody will operate continuously, without interruption, or free of errors. Any part or all of Pody may be interrupted, modified, suspended, or discontinued at any time without prior notice.

You agree that we shall not be liable for any damages arising from the unavailability of Pody or any feature or content thereof. We shall also not be responsible if you are unable to use the Services due to factors beyond our control, including but not limited to your devices, software, hardware, networks, or connectivity services.

Pody does not guarantee that the Services are suitable for any particular purpose of yours, including commercial, advertising, or revenue-generating purposes.

2. Use of Assets​

As between you and Pody, you are solely and exclusively responsible for:

  • all content, including but not limited to images, videos, text, or any prompts that you input or upload to the Services; and

  • all personal, private, or commercial uses that you make or permit to be made of the Assets.

You are responsible for and bear all legal obligations relating to any consents, rights, or licenses required for any content you input or upload to the Services, as well as for any use of your Assets. Pody has no obligation to monitor your use of the Services or the Assets, nor any obligation to notify you of any licensing restrictions or limitations on the use of the Assets. All use of the Assets is at your own risk.

Pody does not confirm, warrant, or represent that your use of the Assets will not infringe the rights of any third party.

3. Commercial Terms​

The Services provided to you may be free or paid services, depending on the information displayed on Pody.ai.

You may stop using the Services and cancel your subscription at any time through the Website. All payments are non-refundable, except where otherwise required by applicable law. This means that if you cancel your subscription, or if Pody terminates your right to use the Services due to a violation of these Terms, you will not receive a refund for any fees already paid.

You understand and agree that we may adjust pricing standards and billing methods for the Services based on business development needs, and may also begin charging fees for Services that were previously free. Such changes will be notified or published on Pody.ai.

Pody respects international intellectual property rights and requires its Members to do the same. Assets may unintentionally resemble copyrighted works owned by others.

If you believe in good faith that materials available on the Services infringe your copyright, you (or your authorized representative) may submit a written copyright infringement notice to Pody via email requesting that such material be removed or access to it be disabled.

5. Third-Party Providers​

Certain content or Services provided through Pody may be provided or maintained by third parties. By using the Services, you acknowledge and agree that we are not responsible for examining or evaluating the content, accuracy, copyright compliance, legality, correctness, quality, or any other aspect of any third-party content or services.

Pody shall not be liable for any losses, damages, or claims arising from or related to the content, services, or conduct of any third party.

6. Term and Termination​

Subject to this Section, these Terms shall remain in full force and effect while you use the Services. Pody may terminate your access to all or any part of the Services at any time without notice if you violate any provision of these Terms. Such termination may result in the loss and deletion of all information associated with your account, including Assets. All fees paid are non-refundable.

Upon termination, all rights and licenses granted to you under these Terms shall terminate immediately. Termination shall not affect any rights or obligations that accrued prior to the effective date of termination.

7. Disclaimer​

Pody, on behalf of itself and its licensors, makes no representations, warranties, or guarantees, whether express, implied, or statutory, regarding the Website, the Services, any materials, user submissions, user content, Assets, Free Tier Assets, or third-party content, including the quality, suitability, truthfulness, accuracy, or completeness of any information or materials contained or presented on the Website and/or the results obtained from the use of the Website or the Services.

Your use of the Services is entirely at your own risk. The Services are provided “as is,” and we make no warranties or guarantees of any kind. In particular, we do not warrant that:

  • your use of the Services will meet your requirements;
  • your use of the Services will be uninterrupted, timely, secure, or error-free;
  • any information obtained through the Services will be accurate or reliable; or
  • any defects in the operation or functionality of any Services will be corrected. In all cases, Pody’s total liability arising out of or relating to the Services shall not exceed fifty United States dollars (USD 50).

8. Disputes​

Any disputes or claims arising from or relating to Pody or this Agreement shall be subject to the dispute resolution mechanisms, governing law, warranty disclaimers, limitation of liability, and other terms set forth on the Website. These Terms of Service and any separate agreements between you and us shall be governed by and construed in accordance with the laws of Singapore.

9. Changes to the Terms of Service​

You may review the most current version of the Terms of Service at this page at any time. We reserve the right to update, change, or replace any part of these Terms by posting updates on the Website. Your continued use of the Website or the Services following the posting of any changes constitutes acceptance of those changes.
